In pratica, la stipula della convenzione, che prevede, fra l’altro, per l’Aci il riconoscimento di «un importo annuo riferito al recupero delle spese e dei costi di ammortamento dei beni strumentali e dei servizi pari ad euro 333mila oltre Iva come da legge , da corrispondersi in rate mensili posticipate di euro 27mila euro oltre Iva come per legge» doveva avvenire tramite una gara pubblica e non in base alla legge 241 del ‘90, che riguarda gli accordi per disciplinare lo svolgimento in collaborazione di attività di interesse comune fra amministrazioni pubbliche.
Secondo l’Autorità per la vigilanza sui contratti pubblici, quindi, «difettando the requirements of collaboration for the joint construction of a public service and the absence of a fee for this cooperation, in this case is not legitimate to use the instrument of the Convention under Article 15 of Law 241/1990 " . A decision, therefore, that might invalidate the entire agreement between the City and AC Foggia, according to the minority councilors, who requested the intervention of the Authority for the supervision and who have declared their satisfaction with the decision taken.
